Please read these Terms carefully before using the FORB CLUB website or enrolling in the membership programme. They set out the scope of our services, your responsibilities, and the basis on which we work together.
The website www.forbclub.com ("Website") and the FORB CLUB membership programme ("FORB CLUB" or the "Programme") are owned and operated by FORBCORP PRIVATE LIMITED ("FORBCORP", "we", "us" or "our"), a company incorporated in India. By accessing the Website, submitting an enquiry, or enrolling in the Programme, you ("you", "member" or "User") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, please do not use the Website or the Programme.
FORB CLUB is a hotel-stay membership programme. Our services consist of membership plans under which members receive hotel, resort, and serviced-accommodation stay benefits, along with stay-planning assistance and member offers connected to those stays.
We do not, directly, personally, intentionally or deliberately, deal in, provide, sell, arrange or facilitate any of the following, and they do not form part of our services:
Our involvement in any holiday, package or plan is limited strictly to the hotel and accommodation component. It is solely the traveller's responsibility to arrange, obtain and pay for their own flights, visas, passports, travel authorisations and insurance, directly or through providers of their own choosing. FORBCORP accepts no responsibility for, and makes no representation in relation to, any of these items, including any inability to travel arising from visa refusal or documentation issues.
If, at any time, any item such as a flight ticket, visa assistance or any similar service was extended along with any package or membership plan, such item was a complimentary promotional gift only, and was sourced from, arranged, managed and fulfilled entirely by independent third-party providers. Any such gift was never a part of our core business or services, was never charged for as a service of FORBCORP, and does not create any obligation on FORBCORP to provide, repeat or support any such item. All responsibility for the fulfilment and quality of any such gift item rested solely with the third-party provider concerned.
The specific benefits, tenure, entitlements, fees and usage rules of your FORB CLUB membership (including any Leisureship plan) are set out in your individual membership plan agreement and plan documents. In the event of any conflict between these Terms and your plan agreement on plan-specific entitlements, the plan agreement prevails. Membership benefits are personal to the member (transferable only where the plan documents expressly permit), have no cash value, and cannot be exchanged for money. Stay benefits are subject to availability, destination-specific conditions and reasonable advance booking as communicated by our team.
Hotel, resort and other accommodation stays are provided by independent hotels and properties that are not owned or operated by FORBCORP. In arranging a stay we act as an intermediary between the member and the property. The property's own terms, policies and house rules apply during the stay. While we take care in selecting properties and will always assist members in resolving issues, responsibility for the services provided at the property (including quality, safety and conduct) rests with the property concerned.
Tour packages, where offered, are made available through our affiliate ForbTours (forbtours.com) and are governed by the forbtours.com Terms of Service. All such tour packages are handled exclusively through ZFORB International FZCO, Dubai, United Arab Emirates, as set out in those terms.
Membership fees, annual subscription fees and any other charges are as stated in your plan agreement or as communicated to you in writing at the time of purchase, and are subject to applicable taxes. All payments must be made only through FORBCORP's authorised payment channels and against an official receipt or invoice. FORBCORP does not store your card details and never asks for card PINs, OTPs or online-banking passwords. Please do not make payments in cash or to personal accounts of any individual; FORBCORP is not responsible for payments made outside its authorised channels.
Cancellation and refund terms for membership plans are as set out in your plan agreement. Cancellation and refund terms for individual stay bookings are as communicated to you at the time of booking. Refunds, where applicable, are processed to the original payment method within a reasonable period after approval.
All content on the Website, including text, graphics, logos, images, page design and software, is owned by or licensed to FORBCORP and is protected under applicable copyright and trademark laws. You may view and print content for personal, non-commercial use only. Any other reproduction, modification, distribution or commercial use requires our prior written consent.
To the maximum extent permitted by law: (a) FORBCORP's aggregate liability for any claim arising out of or in connection with the Programme or a booking is limited to the amount actually paid by you to FORBCORP for the specific service giving rise to the claim; (b) FORBCORP is not liable for indirect, incidental, special or consequential losses, or loss of profits or data; and (c) FORBCORP is not liable for the acts, omissions or insolvency of independent third parties, including hotels, transport providers and third-party gift providers, or for events beyond its reasonable control. Nothing in these Terms limits rights that cannot be limited under the Consumer Protection Act, 2019 (India) or other applicable law.
Our collection and use of personal information is described in our Privacy Policy and Cookie Policy, which form part of these Terms.
By providing your contact details, you consent to receive transactional communications (booking confirmations, membership information, payment confirmations and similar service messages) by phone, SMS, WhatsApp or email. You may opt out of promotional communications at any time by writing to [email protected] or by registering on our DND page.
FORBCORP is not liable for any failure or delay in performance caused by events beyond its reasonable control, including natural disasters, epidemics, government actions, strikes, civil disturbances, or failures of third-party service providers affected by such events. Where a confirmed stay is affected, we will make reasonable efforts to offer an alternative or reschedule.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force. We may update these Terms from time to time; the latest version will always be posted on this page with its "Last updated" date, and your continued use of the Website or Programme after an update constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Republic of India. Subject to applicable consumer-protection law, the courts at Mohali (SAS Nagar), Punjab, India shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, the Website or the Programme.
